Determining Child Custody
California child custody standards emphasize the health, safety and welfare of a child. In most circumstances, regular contact with both parents is recommended as long as it supports the best interest of the child.
Joint custody means parenting time is shared by both parents. Sole custody gives one parent custodial rights and the other opportunities for visitation.
Custody can be physical, legal, or both. Physical custody determines where the child will reside. Legal custody dictates which parent has the right to make important decisions concerning the child, such as medical care, education, and religion.
Child custody can be negotiated between parents and their attorneys. The goal is a reasonable, mutual agreement. If an agreement cannot be reached, the court will decide.
Establishing Child Support
In California, all children under the age of 18 have the right to be supported by their parents. This hold true for children born in a marriage, domestic partnership or out of wedlock.
The amount of child support a parent pays is determined by a number of factors such as net income, health insurance and daycare costs. Certain court-approved add-ons may also become part of the support.
